Terms of Service

1. Acceptance of Terms

By accessing or using the 6app.ca platform ("Platform"), operated by Ball in the 6 Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.

These Terms apply to all users of the Platform, including organization administrators, coaches, parents, guardians, athletes, and visitors.

2. Account Registration

  You must provide accurate, complete, and current information when creating an account

  You are responsible for maintaining the confidentiality of your account credentials

• --

  You must be at least 13 years of age to create an account; users under 18 require parental or guardian consent

• --

  You are responsible for all activity that occurs under your account

• --

  You must notify us immediately of any unauthorized use of your account

• --

  We reserve the right to suspend or terminate accounts that violate these Terms

3. Organization Responsibilities

Organizations that subscribe to the Platform agree to:

  Provide accurate organization information and maintain up-to-date records

• --

  Obtain appropriate consent from parents or guardians before registering minor athletes

• --

  Ensure that authorized personnel (coaches, administrators) use the Platform responsibly

• --

  Comply with all applicable laws regarding the collection and handling of personal information, including data pertaining to minors

• --

  Maintain appropriate background check and safety screening procedures for staff and volunteers independently of the Platform

• --

  Not use the Platform to discriminate against any individual or group

4. Parent and Guardian Responsibilities

Parents and guardians who use the Platform on behalf of minor athletes agree to:

  Provide verifiable consent for any athlete under 13 before their profile is created or claimed

• --

  Supervise the use of the Platform by minor athletes in their care

• --

  Provide accurate information when creating or claiming athlete profiles

• --

  Maintain control over the privacy settings of their child's profile

• --

  Notify us promptly if they wish to revoke consent or request data deletion

5. Payments and Refunds

• --

  Organization subscriptions are billed at $2 per player per program, with no setup fees or contracts

• --

  Payments are processed securely through Stripe; we do not store your full payment card details

• --

  Athlete and parent accounts are free and will remain free

• --

  Refund requests must be submitted within 30 days of the charge in question

• --

  Refunds are issued at our discretion based on the circumstances of the request

• --

  We reserve the right to modify pricing with 30 days advance notice to active subscribers

• --

  Organizations are responsible for any fees associated with player registrations processed through the Platform

6. Acceptable Use

You agree not to use the Platform to:

• --

  Violate any applicable law, regulation, or third-party rights

• --

  Upload or distribute harmful, offensive, defamatory, or illegal content

• --

  Impersonate another person or misrepresent your affiliation with any entity

• --

  Attempt to gain unauthorized access to other accounts, systems, or data

• --

  Interfere with or disrupt the Platform's infrastructure or security features

• --

  Use automated tools (bots, scrapers) to access the Platform without our written consent

• --

  Harass, threaten, or intimidate other users, including athletes, parents, coaches, or administrators

• --

  Use athlete data for purposes unrelated to the Platform's intended functionality

7. Intellectual Property

The Platform, including its design, code, features, trademarks, and content created by Ball in the 6 Inc., is protected by Canadian and international intellectual property laws. "Ball in the 6" is a registered trademark of Ball in the 6 Inc. (trademarked since July 26, 2014).

  You retain ownership of content you upload to the Platform (photos, videos, game data)

  By uploading content, you grant us a non-exclusive, worldwide licence to use, display, and distribute that content as necessary to operate and promote the Platform

• --

  You may not copy, reproduce, or distribute the Platform's proprietary elements without our written consent

• --

  Statistical data and game records generated through the Platform are jointly owned; you may export your own data at any time

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied

• --

  We do not guarantee that the Platform will be uninterrupted, error-free, or secure at all times

• --

  We are not responsible for the accuracy of data entered by organizations, coaches, or other users

• --

  Our total liability for any claims arising from your use of the Platform shall not exceed the amount you have paid to us in the 12 months preceding the claim

• --

  We are not liable for indirect, incidental, consequential, special, or punitive damages

The Platform is a management tool for sports organizations. We are not responsible for any physical injuries, disputes, or incidents that occur during sporting events or activities managed through the Platform.

9. Termination

  You may close your account at any time by contacting us or through your account settings

• --

  We may suspend or terminate your account if you violate these Terms, with or without prior notice

• --

  Upon termination, your right to use the Platform ceases immediately

• --

  You may request an export of your data before account closure; we will make data available for 30 days following a termination request

• --

  Provisions regarding intellectual property, limitation of liability, and governing law survive termination

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario, located in the City of Toronto.

11. Changes to These Terms

We may update these Terms from time to time. We will notify active subscribers of material changes at least 30 days before they take effect. Your continued use of the Platform after updated Terms are posted constitutes your acceptance of the changes.
